Teacher union boss bends to school reform winds

DETROIT (Reuters) - In the maelstrom of criticism surrounding America's unionized public teachers, the woman running the second-largest educator union says time has come to collaborate on public school reform rather than resist.

Randi Weingarten, re-elected this week for a third term as president of the American Federation of Teachers (AFT) with 98 percent of the vote, wants her 1.5 million members to be open to changes that might improve public schools.

That willingness to engage, she says, could win over parents, taxpayers, voters, well-funded pressure groups and cash-strapped cities that have blamed unionized teachers for high costs and poor performing schools.

"We have to unite those we serve and those we represent," Weingarten said in an interview with Reuters at the AFT convention in Detroit. "And we have to think ... what's good for kids and what's fair for teachers?"

Weingarten rebuffed her critics in the union for mistaking collaboration with surrender and said her overwhelming victory in the election showed rank-and-file members supported the move.

"There are a lot of people who are very angry for legitimate reasons and want to hear simply the 'fight back'," Weingarten said. "But this is about fighting for things as well as fighting against things."

Across the United States, public education -- and the often unionized teachers and support staff employed in the sector -- are under attack from reformers who argue the country's schools need to be reformed and partially privatized in order to improve student performance.

Weingarten was attacked by critics for a willingness to throw her support behind deals in places like Philadelphia and Cleveland, where AFT locals bargained away tenure protections, or New Haven, Connecticut, where the union accepted a teacher evaluation system that removes teachers whose students don't perform well on standardized tests.

"Some people would argue what happened in New Haven is not solutions-driven unionism," Weingarten told Reuters. "Do I embrace every single aspect of that agreement? Is everything single aspect of that agreement part of my particular belief system about how education should run? Of course not."

Weingarten's call for greater community outreach strikes many observers as a realistic strategy for building support for public education, long attacked for high costs and poor results.

"She has said she's open to any reform, under certain conditions, except private school vouchers. She's drawn the line there," said Richard Kahlenberg, a senior fellow at a liberal-leaning think tank, The Century Foundation, and author of "Tough Liberal" a biography of former AFT President Albert Shanker.

"But on every other issue - charter schools, merit pay for teachers - she has said that the AFT is willing to talk. And I think that's the right track to take."

SUMMER OF DISCONTENTS

But activists in the union, hardened by the layoffs, furloughs, pay freezes and benefit cuts that states and municipalities have forced on teachers nationwide in a weak economy, remain vocal and leery of Weingarten's blueprint for the future.

"We have to ask ourselves what are the solutions that are driving the particular model that Weingarten is talking about," said Jeff Bale, a professor at Michigan State University who spoke at a panel discussion hosted by AFT dissidents from Chicago and Detroit.

"Concessions don't lead to more prestige with the public. Concessions don't win more credibility at the bargaining table. They lead to more concessions."

Critics say Weingarten's willingness to see traditional job protections like tenure disappear and to accept charter schools, merit pay and other changes is a retreat from core principles and plays into the hands of those who want to eliminate public education, privatize government services and curb the ability of workers to unionize.

What the new approach will mean for AFT's membership remains to be seen. Like its bigger counterpart, the 3.2 million-member National Education Association, AFT has seen its full dues paying membership decline in recent years, according to its official filings with the United States Department of Labor.

AFT spokeswoman Carolyn Fiddler says total AFT membership -- which includes retirees and members paying partial dues -- is actually up from "1.5 million and change" in 2010 to "1.5 million and some more change" in 2012, a claim repeated in the state of the union report issued at the Detroit convention.

At the event, officials said AFT, which represents teachers and other school staff as well as healthcare workers, had signed up 79 new bargaining units in 18 states in the past year.

REAL FIGHT LEFT?

Weingarten told Reuters that there was "real fight left" in the AFT. But the question is how widespread and deep it is.

One convention highlight came when the 3,000 delegates, in a spirited floor vote, unanimously backed a "special order of business" promising the union's full support for "AFT educators in hostile bargaining environment who are fighting to defend fair contracts and the right to bargain collectively."

That describes just about every AFT local in the country.

But the resolution specifically cited five cities, including Chicago, the nation's third-largest public school system, where teachers represented by the Chicago Teachers Union (CTU) have been involved in bitter contract talks with Mayor Rahm Emanuel, a Democrat, and could walk out beginning on August 18.

At a weekend caucus on the sidelines of the convention, delegates from Chicago and Detroit, where an emergency manager has imposed a 10 percent pay cut on teachers, were skeptical the national union has the appetite for strikes or walkouts.

But they agreed, as William Weir, a Detroit public school teacher put it, that "it's time to do things differently."

Activists seemed especially excited by CTU, which resisted an effort by Emanuel to unilaterally impose a longer school day and won -- a rare victory these days for a teachers union.

Debby Pope, who works in the CTU's grievance unit, said the message from Chicago was simple: old-fashioned hardball, combined with outreach to parents and communities likely to be hurt by public school closings, works better than compromise.

"We will not be heard at the table unless we are out there in the streets seen and heard fighting," she said.

As I?ve mentioned before, I see everything through the eyes of a Fantasy Sports player, and a lot of the lessons I?ve learned in life come from knowing how to spot trends, look for value and not just jump at highly touted commodities without doing some research first.

It had no back seat (there was supposed to be one, but it just didn?t have one), and my cousin and I thought we?d be badasses and put some speakers in right behind the seats ? on the ceiling. Well, we nearly drilled through the roof of the car. Football position: Nickelback.

1993 Ford Explorer: We paid over $500 a month for that car. It had a six-CD changer and leather seats and we took our friends everywhere in that thing. We were pretty much awesome. Football position: Backup QB that?s everyone?s favorite.

1980-ish Beat-up Chevy Truck: Went cheap for a year with a beater for driving back and forth to work. Old trucks have so much character in them. Like, grumpy old Uncle Gus kinda character. Football position: Long snapper.

1996 Pontiac Grand Prix: Ahhh yeah, going back to the well. Eventually, by the time I ran this into the ground, the driver?s side door handle wouldn?t work from the outside, so I had to reach over from the inside of the passenger side to open the door. But that wasn?t as bad as the power steering that went bad, which is ALWAYS fun when you valet it somewhere. Football position: Backup tight end.

2004 Ford Explorer: The more things change, the more they stay the same! Love this truck, although two people have already dented both doors, the sun visors have snapped off on both sides and two different lights are blinking at me from the dashboard (you?d think they?d offset each other!) Deutsche Bank to cut 1,900 jobs as profits drop

FRANKFURT, Germany (AP) ? Deutsche Bank said Tuesday it plans to cut about 1,900 jobs, most of them outside Germany, as its earnings fell 46 percent in the second quarter as the European debt crisis hurt its investment banking and trading activities.

The bank, which employs nearly 101,000 people, said about 1,500 of the job cuts will be in its corporate banking and securities divisions and in related infrastructure areas. The headcount reduction will contribute some ?350 million to an overall target of ?3 billion ($3.8 billion) in savings.

Shares in the bank, which had been lower after the earnings report, jumped on the news of the jobs cuts and estimated savings. They were up 3.2 percent at ?25.58 by early afternoon in Frankfurt.

In its earnings report, Germany's largest bank said net profit fell to ?661 million from ?1.233 billion in the same three months a year ago. Income fell at its investment banking division as fewer client companies came to the bank for its services helping them issue shares.

Revenue from trading debt securities ? one of the investment categories most affected by the crisis ? was down. The company said that was partly due to the company taking "deliberately lower levels of risk" due to subdued trading volumes.

Revenues were down 6 percent to ?8.0 billion. A major hit to revenue came at the corporate banking and securities division, where share underwriting and debt trading are located, falling by ?451 million to ?3.5 billion.

The earnings statement was the first reported under new co-CEOs Anshu Jain and Juergen Fitschen, who took over from Josef Ackermann in May.

"The European sovereign debt crisis continues to weigh on investor confidence and client activity across the bank," it said.

European governments such as Spain and Italy are struggling with high levels of debt, and the prospect they might default or need bailouts has unnerved markets.

The earnings release added detail to an early release of a few numbers last week.

Instapaper seeing huge increase in downloads since the Nexus 7 launch

We heard earlier in the week about the success the guys at Shifty Jelly have had since the launch of the Nexus 7, but, it seems they're not alone. Mobelux, the developers of the Instapaper app for Android, has shared some of their own numbers. And, much like Shifty Jelly, there has been a definite increase in download numbers since the launch of the Nexus 7.

The figure, is a massive 600% increase in downloads of the app since the date of the Nexus 7 launch. There is of course every chance that the $25 free credit for the Play Store has helped their cause. But it's great to hear stories of developers increased success since the Nexus 7 came to town. An application like Instapaper is something that would naturally suit a 7-inch tablet -- it's a perfect size for reading on after all. The Nexus 7 is the first 7-inch Android tablet -- not counting Amazon's Kindle Fire -- to really capture consumer interest in large numbers, and so far everything is coming up roses.

Rope a Dope: Drug Testing in Sports Enters a More Aggressive Era

Unusual variations in an athlete's blood could determine guilt, even if no illegal substances are found

For thousands of world-class athletes, a passport is something they can't forget to pack before heading off to London for the summer Olympic games. But for a few athletes, a different kind of passport is keeping them out of competition entirely.

A new anti-doping program known as the athlete biological passport (ABP), which looks for indirect evidence that an athlete has cheated, is being implemented by several international sports authorities. Already the testing scheme, developed by the World Anti-Doping Agency (WADA), has ensnared world-class athletes?and survived a challenge to its validity.

The London Olympics mark the first summer games in which the ABP will be in use alongside traditional drug screenings. And for competitors in sports that have taken up the program, such as cycling and track and field, dreams of Olympic glory will depend on their test results?past and present.

Rather than screening an athlete's blood or urine samples for traces of banned substances right before or after a competition, testers using the ABP scheme compare samples with an athlete's baseline profile, as determined by multiple tests over time. In the absence of a legitimate physiological explanation, such as an illness or a natural response to changing altitude, variations in an athlete's biological samples can reveal wrongdoing even if the specific doping agent or process remains undetected. For instance, a sudden change in the number of reticulocytes, or immature blood cells, might provide indirect evidence that an athlete has used erythropoietin (EPO), a hormone that stimulates the generation of red blood cells and boosts the oxygen-carrying capacity of the blood. Similar tests can assess levels of the respiratory pigment hemoglobin, which can also reveal instances of blood manipulation to enhance oxygen transport.

"In this way, the athlete becomes his own reference point," says WADA medical director Alan Vernec. "Otherwise you're forever chasing after new types of substances or agents that are being developed."

So far the biological passport has been applied primarily to detect instances of blood doping, but the same strategy could be used on urine samples to identify users of anabolic steroids. Nevertheless, the ABP is unlikely to supplant conventional testing schemes that detect prohibited molecules, such as steroids or human growth hormone, in blood and urine. Anti-doping experts view the passport approach as a complement to such tests, which continue to catch athletes breaking the rules.

Indeed, conventional testing still plays a significant role in cycling, the first major sport to sign on to WADA's passport approach. In the highest-profile recent case, Spanish cyclist Alberto Contador was issued a two-year suspension and stripped of his 2010 Tour de France win after a sample that year tested positive for clenbuterol, which WADA classifies as an anabolic agent.

The International Cycling Union (UCI), suffering from a severe credibility problem, adopted the ABP in 2008, collecting about 10 blood samples each from more than 800 riders over the course of the year. But implementation of the ABP has not been without twists and turns. Cyclist Franco Pellizotti, who raced for Italy in the 2008 Olympics, was suspended in 2010 for irregularities in his blood profile that indicated "enhancement of oxygen transfer." But the rider was soon exonerated by the Italian Olympic committee, which held that the evidence against Pellizotti was insufficient to prove his guilt.

The cycling union appealed to the Court of Arbitration for Sport (CAS) in Switzerland, which last year overturned the Italian committee's decision and reinstated Pellizotti's two-year ban from cycling. The court also upheld a two-year ban for Italian rider Pietro Caucchioli; the cyclist's variations in hemoglobin concentration over a span of several months, the court ruled, "could not be considered as physiological" and hence demonstrated doping to enhance the blood's oxygen-carrying capacity.

Taiwan?s law against adultery (xing-fa ??, also known as ?Criminal Law Number 239? in the legal code, may seem a strange and archaic animal to some.

To this day adultery is a criminal offense that is punishable by up to one year in prison, with penalties applying to both sexes.

In place since 1935, Taiwan?s Department of Justice defines adultery as ?a married person who has sex with another person.?

?Fornication? is defined in Taiwan as an adulterous sex act, but specifically it must entail sex with someone of the opposite sex; and involve penetration of one?s sex organ into/by another person?s (reproductive) sex organ, exclusively.

To clarify, none of the following is considered an adulterous act: a ?handjob?, ?blowjob? or anal sex; or homosexual sexual activity.

Most of the time, perhaps 70% of it, charging a spouse with adultery is attempted by the wife, as part of a way to secure a more lucrative divorce settlement. Conversely, a man may try to press charges against the wife to try to avoid parting with his personal fortune.

To prove adultery has taken place, however, can be tricky. A woman might hire one of Taiwan?s countless private ?dicks? specializing in this field to follow the husband and take pictures as he leaves ?a love motel?, for example, with his mistress (called xiao san or ?little third?, the third person in the marriage).

The photographic evidence then has to convince the judge in a court of law that adultery indeed has been committed. It?s a criminal case; whereas the divorce proceedings are a civil case, under family law.

If the ?injured? party files charges against the offending spouse, the lover must also be charged. One or both of those charges, though, may also be dropped.

The ROC?s (Taiwan?s) legal system and its adultery law is affected by Antragsdelikt; in criminal law, this is a category of offense which cannot be prosecuted without a complaint by the victim, (in Chinese, gaosu nailun, ????, an influence of German and Japanese legal systems, a legal practice also seen today in Japan and South Korea.

Adultery is a civil not public type of prosecution, and there?s no jury involved; in fact, juries are not part of the Taiwan legal system at all.

In the past, Taiwan?s adultery law has been used as a legal means of exacting revenge. Until the year 2000, someone could sue a spouse for adultery after the divorce had actually taken place. In one case, for example, a woman sued her ex-husband for adultery after the fact.

Some judges began to find this law inappropriate, however, and asked for a panel of judges to preside in order to interpret the law, ultimately changing it.

As international comparison, in China adultery is not considered a crime, but is considered grounds for divorce. (Wikipedia?s ?adultery? entry)

Binoculars don't just bring birds into focus?they're a cheap, portable tool for zooming in on the night sky too. The handheld lenses let you examine a wide field of view, right side up and with both eyes, unlike most backyard telescopes. Robin Scagell, co-author of Stargazing With Binoculars, advises setting up shop a mile from well-lit areas. "Avoid looking at bright lights before you go out," he says. "And give yourself 20 minutes to let your eyes adapt to the darkness."

Start by checking out craters in the nearly full moon, which in the U.S. will be in the southeastern portion of the night sky in early August. Then look for Mars and Saturn hugging the horizon to the southwest. Pick up the trail of the Milky Way arcing overhead, and follow it to features such as the Butterfly Cluster and Eagle Nebula. To spot fainter objects, such as the Andromeda Galaxy, wait until the moon wanes. Scagell also suggests relying on more sensitive peripheral vision: Gaze to the side rather than directly at where an object is located. As midnight approaches on Aug. 11 and 12, set down the binoculars and face south to take in the fast bright streaks of the Perseids meteor shower.

CyanogenMod team member Brint Kriebel announced on Google+ that CM10 is now available in ?preview build? form for the Verizon Galaxy Nexus. It has its share of bugs, but Kriebel says that he has been using it as his daily driver for a little over a week.

This is great news for Verizon Galaxy Nexus users, as Verizon and Samsung have yet to announce their plans to officially update the device to Jelly Bean.

Google and Facebook's new tactic in the tech wars

FORTUNE -- If the Electronic Frontier Foundation, the nation's preeminent digital rights nonprofit, had disclosed last year that it received a cool $1 million gift from Google -- about 17% of its total revenue -- some eyebrows might have been raised. The group typically describes itself as "member-supported" and, like most nonprofits, it treasures its above-the-commercial-fray, public-interest-group aura and reputation for independence.

In fact, Google (GOOG) did transfer $1 million to the EFF last year, but the money did not have to be, and wasn't, reported as a corporate donation. And if, as currently planned, the EFF receives another $1 million this year from Facebook (FB), it won't have to report that as a donation either. That's because both transfers are formally court-ordered outlays being paid by those companies to settle class-action suits.

"Well, of course those aren't donations!" the reader might interject. "They're the diametric opposite: involuntary, judicially mandated payments forced upon them by an adversary!" That's not the whole story either. These payments to the EFF are being made in suits the EFF played no role in bringing, and the defendants themselves -- Google and Facebook, in these instances -- helped select EFF to be their beneficiary.

These weird, hybridized outlays -- part punitive fine, part voluntary donation -- are called cy pres awards, meaning "as close as possible" (from the old Norman, cy pres comme possible). The theory behind them goes like this: In settling, the plaintiffs lawyers and the defendants agreed that awarding damages to actual class members would be impractical, because the sums owed each would be so tiny as to not warrant the expense of distribution. Accordingly, the parties agreed to pay the class nothing, but to pay a sum instead to charities that would serve as the next best thing, because the charities would theoretically promote the interests of class members in some indirect fashion pertinent to the lawsuit.

These two awards to the EFF, for instance, stem from suits that alleged that Google and Facebook each violated their customers' privacy rights -- in Google's case, by exposing users' email contacts during its botched launch of its Google Buzz social network in February 2010 and, in Facebook's, by exploiting users' (including minors') identities and likenesses without express permission in its so-called "Sponsored Stories" ads in January 2011. In these two cases 21 other nonprofits also received, or stand to receive, money, though the EFF would be the biggest winner, taking in about 12% of the total $16.1 million doled out. (While the Google Buzz settlement was approved in May 2011, the Sponsored Stories settlement was just proposed in June, and is still being challenged by dissenters.)

Giving?cy pres?money to the EFF makes sense, the parties in each case have argued, because digital privacy issues are one of the subjects the EFF monitors. It has not infrequently scolded (though never sued) Google and Facebook for privacy glitches and intrusions, and has advocated privacy legislation and policies that those companies oppose.

At the same time, the EFF is often an ally of Google and Facebook when it comes to staving off liability to rights holders over user-generated infringing content, like pirated movies, photos, or music. Perhaps for these reasons, for instance, Google gave EFF about $25,000 in conventional, purely voluntary donations in 2010, and about $18,000 more in 2011.

In fact, at least half of the?cy pres?recipients in these cases would very likely be getting at least some donations from Google or Facebook this year, whether or not any suit had ever been lodged against them.??For instance, the Center for Democracy and Technology (CDT), which got $500,000 from the Google Buzz?cy pres?award in 2011, received $340,000 in voluntary contributions from Google the year before. It's now slated to receive $1 million from the proposed Facebook award, though Facebook has been listed as one of CDT's leading e-commerce benefactors since at least 2009. Similarly, the Center for Internet and Society at Stanford (CIS), which received $500,000 from the Google Buzz award, had collected $400,000 in voluntary contributions from Google the year before (which amounted to 51% of CIS's total revenue that year). This year CIS will collect $600,000 from Facebook's Sponsored Stories settlement, if approved.

The EFF, CDT, and Stanford's CIS all reliably line up on the tech sector side in scrimmages with copyright holders. All three supported, for instance, the January Internet blackout protest against the Stop Online Piracy Act -- legislation opposed by both Google and Facebook. EFF and CDT also each submitted amicus briefs supporting Google in its two most important recent litigations: Viacom's suit against Google's YouTube unit for copyright infringement, and a suit by Rosetta Stone, the language course company, challenging Google's practices of auctioning off other companies' trademarks for use as paid-search keywords and allowing them to be used in ad text as well.

Now if some neutral individual had been tasked with awarding money to a charity that was single mindedly devoted to fighting precisely the sorts of wrongs alleged in the Google Buzz and Sponsored Stories class actions, his first choice would probably have been one that the settling parties in each case passed over entirely: the Electronic Privacy Information Center (EPIC).

Unlike any of the 22?cy pres?recipients jointly proposed by the parties in the two cases, EPIC actually filed complaints against Google and Facebook with the U.S. Federal Trade Commission over the Google Buzz launch and Facebook's use of members' identities and likenesses in ad campaigns without permission. Prompted by EPIC's complaints, the FTC brought enforcement actions against each company which culminated in consent decrees.

How, then, could the parties -- again and again -- have overlooked EPIC when doling out the cash? How, indeed, when so many of the groups that the parties did select?like the YMCA of Greater Long Beach, Youth Radio of Oakland, the Brookings Institute (a regular Google beneficiary), and the MacArthur Foundation (a regular Facebook beneficiary) -- are hardly thought of as digital privacy watchdogs?

Could it be that the defendants in each case blackballed EPIC precisely because it was too aggressively devoted to combatting the wrongs that allegedly harmed the class? Lead Google Buzz plaintiffs attorney Gary Mason declined to comment, explaining that settlement negotiations are confidential. Two lead plaintiffs attorneys in the Sponsored Stories case did not return calls.

In the Google Buzz case in March 2011, EPIC and seven other privacy-focused nonprofits objected to their exclusion from the?cy pres?funds, protesting that the plaintiffs lawyers and Google had, in effect, arranged to give the majority of those funds "to organizations that are currently paid by Google to lobby for or to consult for the company." (The EFF, CDT, and CIS all reject that characterization of their relationship to Google. They aver, rather, their complete independence, and stress that any corporate donations they accept are "unrestricted" in nature?meaning that they come with no strings attached.)

In May 2011, Chief Judge James Ware of the federal district court in San Jose granted EPIC's request, carving out a $500,000 tranche for it. (At the same time he spontaneously?without prompting from anyone?sliced off another $500,000 piece for an ethics center at Santa Clara University, a school where Judge Ware serves on the law school faculty.)

Tech companies did not invent?cy pres?awards. The doctrine is ancient, having arisen to address a recurring problem in trusts law. For instance, when President Franklin D. Roosevelt set up the March of Dimes Foundation in 1938, he specified that it would fight polio. But once that disease was tamed, the foundation sought permission to fight other diseases. Invoking the?cy pres?doctrine, courts granted its request, finding that doing so would carry out Roosevelt's original intent as closely as possible.

In the 1980s the?cy pres?doctrine?"or rather something parading in its name," as federal appeals court judge Richard Posner archly put it in a 2004 ruling?burrowed its way into the realm of class-action settlements. Critics have referred to?cy pres?awards as judicial "slush funds," since judges, plaintiffs lawyers, and?as the Google Buzz and Sponsored Stories cases suggest?even defendants can use them to further their own agendas. In the past ten months three federal appeals courts have struck down?cy pres?awards after concluding that they funded charities that had virtually nothing to do with the class members for whom the cases were ostensibly filed.

The key recurring concern with any class action settlement is that plaintiffs attorneys, desiring to maximize their fees, and defendant corporations, eager to minimize total payout, will collude to achieve their goals at the expense of class members.?Cy pres?awards can be enlisted in that abusive process, attorney Theodore H. Frank of the Center for Class Action Fairness, has written, by "disguising the true cost of a settlement to the defendant to maximize the share of the actual recovery received by the plaintiffs attorneys."

For instance, in the Google Buzz case, on the face of things the plaintiffs attorneys were receiving about one-quarter of the total award -- $2.1 million of an $8.1 million fund -- which sounds well within the normal range. Yet a critic might protest that none of this particular award went to the actual class members, while much of it went to charities the defendant probably would have funded to some degree anyway. If so, then the attorneys fees may have been excessive given how little the lawyers actually won for the class.

In the Facebook class action, the potential for fee inflation is even more palpable. If the deal is approved, the plaintiffs attorneys get $10 million, the nonprofits get $10 million, and the class members get zilch, which does not look great even on its face. To the extent that some of the nonprofits are also regular beneficiaries of Facebook's largesse, and would likely have gotten at least some of their?cy pres?money even without any lawsuit, the attorneys would be getting more than half the cash generated by the settlement, which looks even worse.

In court papers supporting the deal, the plaintiffs stress that the Facebook settlement also includes injunctive relief from which class members may benefit in the future, because Facebook has agreed to fiddle with some of the fine print in its terms-of-service agreements and to give its users opportunities to "opt-out" of the Sponsored Stories program. The plaintiffs then claim that these structural changes are effectively worth --are you sitting down? -- $103 million to the class, because class members will "now have the opportunity to control the use of what is essentially a [redacted]/month advertising asset." (The redacted figure remains under seal.)

In July, EPIC and attorneys representing other objecting class members each challenged the adequacy of the Facebook settlement. Alternatively, EPIC and three other privacy groups have asked the court to redetermine cy pres recipients using transparent, open-application procedures. These objections have not yet been ruled upon, in part because, as soon as they were lodged, U.S. District Judge Lucy Koh recused herself from the case. Though she did not state her reasons, she and her husband had ties to some of the charities that stood to gain from the settlement, according to published reports

Since other?cy pres?awards have been upheld despite similar or worse apparent conflicts, Judge Koh's sensitivity was at least progress of a sort.

Health researchers say menopausal women who exercise may experience fewer hot flashes in the 24 hours following physical activity.

In general, women who are relatively inactive or are overweight or obese tend to have a risk of increased symptoms of perceived hot flashes, noted Steriani Elavsky, assistant professor of kinesiology at Penn State.

Perceived hot flashes do not always correspond to actual hot flashes. Most previous research analyzed only self-reported hot flashes. This is the first study known to the researchers to look at objective versus subjective hot flashes.

Elavsky and colleagues studied 92 menopausal women for 15 days. The women recruited for this study were different from many earlier menopause studies, said Elavsky.

In the past, women in menopause studies were experiencing severe symptoms and seeking help. They were probably not representative of the general population.

"Our sample included women with mild to moderate symptoms and they were recruited for a study of physical activity, not for a study of menopause," said Elavsky.

"We recruited women residing in the community. We used recruitment sources that included a variety of outlets in the community frequented by women, like libraries, fairs, gyms, advertisements in local newspapers, etc," she noted.

The women were 40 to 59 years old, with an average of two children and were not on hormone therapy. During analysis the researchers separated the women into normal weight and overweight/obese categories and higher fit and lower fit categories. These categories were not necessarily mutually exclusive.

The participants wore accelerometers to monitor their physical activity and also wore monitors that measured skin conductance, which varies with the moisture level of the skin. Each participant recorded the individual hot flashes she had throughout the 15-day period on a personal digital assistant.

Through these two methods of recording hot flashes, the researchers found the frequency of objective and subjective hot flashes. Objective hot flashes occurred when the monitor recorded them; subjective hot flashes occurred when the woman reported them. When an objective and a subjective hot flash were recorded within five minutes of each other, it was considered a "true positive" hot flash, the researchers said.

"Some physiological explanations would suggest that performing physical activity could increase hot flashes because it acutely increases body core temperature," said Elavsky.

To the contrary, the researchers found that this premise was not true, as on average the women in the study experienced fewer hot flash symptoms after exercising. However, the women who were classified as overweight, having a lower level of fitness or were experiencing more frequent or more intense hot flashes, noticed the smallest reduction in symptoms.

It is not yet known if a woman could use diet and exercise to lose weight and become more fit and therefore experience fewer hot flashes, but it is a possibility worthy of future investigation, noted the researchers.

"For women with mild to moderate hot flashes, there is no reason to avoid physical activity for the fear of making symptoms worse. In fact, physical activity may be helpful, and is certainly the best way to maximize health as women age. Becoming and staying active on a regular basis as part of your lifestyle is the best way to ensure healthy aging and well being, regardless of whether you experience hot flashes or not. ," said Elavsky.

Here's one upside to weeknights ??until September 27, it gives you a good excuse to visit The Larder, the pop-up taking place at Otto Ristorante in Woolloomooloo.

Otto is great, undoubtedly, but the first I dined there in 2007, I did feel like an income-bracket tourist. It's a restaurant known for its ritzy celebrity clientele, after all, and my salary has zero ritz attached. My poker face got good practice when I saw the orange juice cost $8. It was a damn fine fresh-squeezed OJ, though, full of high-brace citrus and sweetness. The meal was course-by-course brilliance, but as much as I loved it, it just wasn't the kind of place I could afford to go to regularly.

This is what makes The Larder so excellent ? it's Otto for the everyday. In fact, at the pop-up, my entire dinner (including dessert and a drink) cost the same as the main course I last had at Otto. Not only is The Larder wallet-appeasing, the food is damn good. The Pearl Barley Risotto ($15) is wonderfully light and spring-loaded with corn, mushroom and pea flavours. The Potato Rosti ($15) is a delicious, pan-crisp base camp for the roasted capsicum, feta, rocket and addictively smoky eggplant that sits on top. Will's Pork Belly ($25) was equal parts tender and juicy and well supported by a light, honey-dressed salad of brussel sprouts, walnuts and radicchio. These are the sorts of great things you can expect from the kitchen of Otto head chef, Richard Ptacnik.

Adding to the budget-friendly nature of The Larder is the fact you can BYO. If you don't get a chance to detour to a bottle shop beforehand, though, you can pick a drink from Otto's lengthy list or enjoy one of the specials (such as a winter-compatible glass of mulled wine).

It's also worth noting the other one-off additions to the nightly menu ? especially with the desserts. We had a Pear and Rhubarb Crumble that was worth that extra level of detective work. The Larder, Otto, Woolloomooloo

So check out The Larder while it's around ??you don't even need to practice your poker face. It's hard to undo the smile you get from enjoying such excellent, reasonably priced food.

Games opening sparks betting flurry on filmmaker Boyle

LONDON (Reuters) - Bookmakers expect record gambling on the 2012 Olympics after the opening ceremony prompted a flood of bets on event mastermind Danny Boyle receiving a knighthood - and confusion over wagers laid on who would light the Olympic flame.

Since London won the Olympics in 2005 gamblers have forked out on the closely guarded secret of who would light the flame, with British five-times gold medallist, rower Steve Redgrave, the clear favourite.

But in the end, seven young athletes selected by seven British Olympians lit the flame in unison, causing divides in the bookmaking ranks over how to handle the bet.

Ladbrokes and Stan James decided to pay out on all seven of the British Olympians involved which included Redgrave, Daley Thompson and Kelly Holmes.

William Hill voided all bets and refunded about 50,000 pounds ($80,000) wagered on the event since 2005.

"It is a bit disappointing as we've been taking bets on this for years and in the end there is no winner. There is no way anyone could have predicted any one or all of the seven people chosen," William Hill spokesman Graham Sharpe said.

Stan James said it had voided all losing bets, meaning punters got their money refunded.

"It's a once in a lifetime occasion and we thought it appropriate to make this gesture after such an incredible start to the London Olympics," spokesman Rory Jiwani said.

Bookmakers said the success of the opening ceremony devised by Boyle, who won an Oscar for his movie "Slumdog Millionaire", had ignited a feelgood factor and already boosted gambling interest in the Olympics - and not just in the sports.

QUEEN ON FILM

Boyle, 55, is being tipped to be awarded a knighthood in the New Year Honours List by the Queen, whom he somehow managed to persuade to take part in her first movie role.

During the opening ceremony, a film showed James Bond actor Daniel Craig arriving at Buckingham Palace and escorting the Queen to a helicopter. Minutes later a helicopter appeared over the stadium and released two parachutists. The Queen then walked into the stadium to huge cheers from the 60,000 crowd.

"Everyone was amazed and wowed at what Boyle did last night," Ladbroke's spokeswoman Jessica Bridge said. "Before this Danny Boyle was 2-1 to get a knighthood but due to the sheer volume of bets we have cut this to 5-4."

She said the largest bet so far was 5,000 pounds.

Coral spokesman David Stevens said they were running odds on Saturday of 6-4 that Boyle is knighted next year, having been 4-1 immediately after the opening ceremony.

Jirwani said the ceremony had boosted patriotic pride with odds of 4-5 that the British team will win more than 22 gold medals compared to 19 in Beijing which could push them above Russia to be third in medal table behind the United States and China.

Bookmakers are forecasting between 50-100 million pounds ($80-160 million) will be wagered on the London Games, which would be four to five times more than gambled at Beijing but still way short of other major sporting events.

They expected plenty of money on football and tennis with some interest in cycling after Bradley Wiggins' Tour de France victory.

The men's 100 metres race, a highlight of the Olympics, was not seen as a great draw for gamblers.

Mark Maydon, commercial director of the Sporting Index Group, said the odds were against Jamaica's Usain Bolt setting a new world record at this event after stunning the world with his 9.69 second win at Beijing. Bolt cut this to 9.58 a year later.

He predicted the 100 metres would be run in 9.71 seconds with only half of the 8-strong field running under 10 seconds.

Sharpe said gamblers were not enthusiastic about the race.

"It really is a two-horse race between Bolt and (fellow Jamaican) Yohan Blake and gamblers like to have a bit more competition than that," he said.
