TransAlta profit rises on lower maintenance costs

(Reuters) - Canadian power generation company TransAlta Corp reported a 58 percent rise in fourth-quarter profit, helped in part by lower maintenance costs.

Net earnings attributable to common shareholders rose to C$38 million ($37 million), or 15 Canadian cents per share, from C$24 million, or 11 Canadian cents per share, a year earlier.

Comparable earnings rose to 21 Canadian cents per share from 13 Canadian cents per share.

Revenue fell 6 percent to C$661 million.

DirecTV acquires 4K trademarks | Advanced Television

There?s no comment and absolutely nothing official but it seems that DirecTV, the US-based giant DTH broadcaster, is at least preparing for the introduction of something in Ultra-HDTV (or 4K for broadcast).

DirecTV has filed with the US Patent & Trademark Office a bunch of new applications in readiness for this new transmission method. The names registered include: 4K, 4KN, 4KNET, 4K Network and 4KNetwork.

Filing a trademark need only cost $149 a time (plus legal fees), so securing the terms seems a modest investment for what might be extremely valuable terms in a few years.

(AP) ? Thin barrier islands five miles off the tip of the Alaska Peninsula shelter Izembek Lagoon from the Bering Sea, but it's what's beneath the surface that makes the lagoon special and part of a brewing, cross-continent fight.

Sen. Lisa Murkowski is pushing for a road between King Cove, population 938, where flying is often impossible, and Cold Bay, home to an airport that can operate in almost any weather. The U.S. Fish and Wildlife Service and outgoing Interior Secretary Ken Salazar last week rejected a land swap that would have allowed the road to be built through the refuge, skirting the lagoon.

Murkowski and her allies say a road would be safer than what's happening now. Local residents of King Cove have died trying to fly to Cold Bay and a hospital in Anchorage. Murkowski isn't backing down, and has threatened to block President Obama's choice to head the Interior Department, Sally Jewell, unless the administration agrees to a land exchange that will lead to construction of a road.

"I'd like to think that I'm not going to have to use that tool, but it's available to me and I am going to do everything that I can within my power as a United States senator to make sure that the safety of the people in the King Cove/Cold Bay region is not compromised," she said.

The political battle is far from the peaceful heart of the lagoon, where the world's largest known bed of eelgrass grows upward in green ribbons from the shallow ocean bottom. Every fall, the eelgrass provides a buffet for millions of geese and other waterfowl as they leave Alaska or Russia for warmer climates.

Almost the entire population of Pacific brant descends on Izembek National Wildlife Refuge, foraging a mile or so offshore. The small sea geese watch for bald eagles launching attacks from bluffs. Endangered Steller's eiders feed on tiny invertebrates. Tundra swans, emperor geese and countless shorebirds make appearances.

Murkowski, generally an advocate for environmental issues, has argued that people should come first in this particular case.

Coast Guard helicopter crews answered five emergency calls in King Cove last year. Murkowski said they regard the King Cove airport as the most dangerous in the state. A 1981 crash out of King Cove killed a pilot, a nurse practitioner, a health aide and a crab fisherman who was being evacuated because his foot had been severed. Treacherous weather conditions have doomed other flights, including six in a 1982 crash on a flight from Kodiak to King Cove.

Debate over environmental values versus human life at Izembek has been going on since most of the Izembek National Wildlife Refuge was designated as wilderness in 1980. King Cove residents say they were not consulted before their access was restricted.

Residents seeking a road in 1998 received a sympathetic reception in Washington, D.C., but left with a consolation prize. Congress appropriated $37.5 million to upgrade medical facilities and a spend $9 million on a hovercraft.

Icing and big waves often kept the hovercraft in port, said Aleutians East Borough Administrator Rick Gifford. At $73 for a one-way ticket, the projected revenue never materialized. The boat turned into a $1 million annual drain on the budget and the borough ended service in November 2011. It was transferred to another city within the borough.

With the hovercraft out of the picture, King Cove officials renewed their call for a road. With the backing of the state and an Alaska Native corporation, they made an offer they thought the federal government could not refuse: 43,093 acres of state land and 13,300 acres of land owned by King Cove Corp. for a 10-mile corridor through the refuge and acreage from another federal refuge.

The U.S. Fish and Wildlife Service and Salazar concluded the additional acreage could not match the quality of habitat at Izembek and would disrupt the birds.

Salazar will meet Thursday with King Cove residents, and he could change his mind. But Noah Matson, vice president for landscape conservation for Defenders of Wildlife, said Salazar made the right call for now and for future generations. He believes the 1998 compromise for a marine route was the best answer because it protected internationally recognized wetlands, he said.

"The hovercraft successfully transported, safely, many people from King Cove to Cold Bay," he said.

The proposed road would run along what's essentially a fjord, he said, with avalanche danger and erosion potential for the bay. The same wicked winds that ground airplanes and hovercraft will render a road impassible with snow drifts, he said, and make the road as expensive to maintain as the hovercraft.

Salazar likely took seriously his responsibility to balance the needs of the people of King Cove with protection for the refuge, Matson said, and Murkowski's threat to put a hold on Salazar's replacement is not appropriate.

"It's unfortunate that she's politicizing this issue," he said.

UPDATE 2-Mexico retail sales slump, bets rise for rate cut

MEXICO CITY, Feb 21 (Reuters) - Mexican retail sales fell by

the most in over a decade in December, reinforcing bets the

country's central bank could soon cut interest rates to support

growth in Latin America's no. 2 economy.

Retail sales fell 3.6 percent from the prior

month, missing expectations in a Reuters poll for a 1.1 percent

contraction, on a drop in sales of electronic goods, computers

and cars.

It was the steepest decline since February, 2001 and came in

well below the downwardly revised 0.73 percent expansion notched

in November.

'It is a surprising fall,' said Pedro Tuesta, an economist

at 4Cast in Washington DC.

Healthy consumer spending helped Mexican output heat up in

the fourth quarter last year, picking up the slack from a dip in

manufacturing that had previously sheltered the country from the

worst of the global slowdown.

Yields on Mexican interest rate swaps edged lower

after the data as investors added to bets that the central bank

could cut its 4.50 percent benchmark rate as soon as March.

The Mexican economy moves in lockstep with that of its

northern neighbor, where politicians narrowly averted a package

of tax hikes and spending cuts originally set to kick in in

January.

'People were very concerned about what was going to happen

with the U.S. fiscal cliff,' Tuesta said. Slowing U.S. growth

would likely push Mexican consumers to retrench.

Some $85 billion in spending cuts will begin to hit the U.S.

economy after March 1 if lawamkers do not soon reach a deal.

Mexico's central bank will be closely watching the outcome of

talks as it heads into a rate decision meeting next month.

The bank has said it could cut interest rates if inflation

continues to cool and the economy flags. Mexico's economy grew

3.9 percent in 2012 and is expected to slow to 3.5 percent

expansion this year.

The market is pricing in slightly more than even odds of a

25 basis point cut in March, and eyeing a good chance for a

half-percentage point cut during the year.

MIXED SIGNS

Retail sales in November were boosted by a long-weekend when

stores offered discounts right after early year-end bonuses,

sapping some of December's demand.

Mexican consumer confidence slipped off of a nearly

five-year high in January as shoppers in Latin America's second

biggest economy showed less willingness to make big purchases.

That same month the Mexico's retailers' association

announced a feeble 0.5 percent growth in sales in January at

stores that have been open at least 12 months.

The association has still said it is eyeing 5 percent growth

in 2013 on continued strength in department store sales.

The statistics agency also said on Thursday that retail

sales in December dropped 1.8 percent from a year

earlier, compared to expectations for a 2.1 percent rise and a

3.5 percent annual rate in November.

Chesapeake Energy board finds no wrongdoing by CEO

An investigation by Chesapeake Energy Corp.?s board of directors into outgoing CEO Aubrey McClendon?s personal financing deals with company partners has found the deals did not benefit McClendon improperly or cost the company more.

The company said Wednesday that ?no intentional misconduct by Mr. McClendon or any of the company?s management was found.?

McClendon, who founded Chesapeake in 1989 and saw it become the second- largest natural-gas producer in the U.S., had a special arrangement with the company that allowed him to invest personally in the oil and gas wells the company drilled.

As the company expanded and oil and gas prices fluctuated, McClendon needed to borrow money to pay for his stakes in the wells, and he used those stakes as collateral to do so.

Last spring, Reuters reported that McClendon received loans of $1.4 billion from an investment firm called EIG Global Energy Partners that was negotiating a separate oil and gas deal with Chesapeake.

The probe sought to discover if McClendon, who was then chairman and CEO of Chesapeake, received a special deal from EIG and in return sold the company?s assets at lower-than-market value. The probe also looked further back into other similar deals McClendon may have struck.

The company announced Wednesday, ?The review of the financing arrangements did not reveal any improper benefit to Mr. McClendon or increased cost to the company as a result of the overlap in the financial relationships.?

Chesapeake said McClendon had no comment on the findings.

McClendon was stripped of his role as board chairman in May. Last month, Chesapeake announced McClendon would leave the company April 1 amid philosophical differences.

The Wii U launch sort of came and went, didn't it? I mean, it's a nice console, but it certainly didn't cause any major waves. In fact, Nintendo only sold 57,000 units in January. For those who don't track game console sales numbers -- and why would you -- that's bad. Very bad.

The Wii U, at least so far, has underwhelmed consumers. There isn't a killer application just yet, and despite some interesting innovation with the touchscreen controller, no one is sitting in his living room, staring at an empty space in his entertainment rack, thinking, "You know what I need? A Wii U."

And now we're all waiting so see what Sony does with the PlayStation 4. Rumors are that they'll do what Sony always does: Pack a ton of technology into a package that will be expensive -- but cost less than it should -- in order to get early adopters on board. It's actually possible that by the time this column is posted, Sony will have already released details about its upcoming hardware and you're too busy oohing and ahhing about frame rates and visual controllers.

Game of Thrones star Jason Momoa is in negotiations to play the heroic Drax the Destroyer, a human placed in the body of a powerful alien. Zero Dark Thirty star Chris Pratt has already been cast as lead hero Peter Quill, aka Starlord. The Guardians will hit screens next summer.

- It seems like a new bit of Star Wars news is unveiled every day, and today is no different. John Williams, music composer for all six Star Wars films, has expressed interest in returning for the upcoming third trilogy. Considering the main Star Wars theme is one of the most iconic pieces of music in film history, it would be an divisive move to not bring Williams back into the fold. Major powers to make 'substantial offer' to Iran

LONDON (Reuters) - Major powers are ready to make "a substantial and serious offer" to Iran during talks next week in return for concessions on its nuclear program, a Western diplomat said on Wednesday.

He declined to give details of the offer - aimed at reviving efforts to reach a diplomatic solution to long-stalled talks over Iran's disputed nuclear work.

"We will take an offer with us which we believe to be a substantial and serious offer," the diplomat said of talks in Almaty, Kazakhstan. "This is an offer which we think has significant new elements in it."

The West has imposed heavy economic sanctions on Iran to persuade it to abandon those parts of its program the powers suspect are intended to give it nuclear weapons capability.

Iran denies seeking nuclear weapons, saying its nuclear program is for peaceful, civilian purposes only.

"Diplomats are committed to finding a diplomatic solution, but the government of Iran really has to show that it's doing what it says it's doing," the diplomat said, on condition of anonymity.

The five permanent members of the Security Council along with Germany - the so-called P5+1 - will hold talks with Iran in Almaty on February 26.

Western officials in Washington have told Reuters they plan to offer to ease sanctions barring trade in gold and other precious metals in return for Iran shutting its Fordow uranium enrichment plant - a proposal already rejected by Tehran.

The Western diplomat declined to comment on that, nor to say in what way the offer to be made in Almaty would differ.

Another Western diplomat said hopes for the meeting were not "sky high" but the talks were being viewed as an opportunity to engage with Iran. "It's an open and positive offer and we hope that they will respond," he said.

"We've always offered quite a bit. The original offer in 2008 was a very generous offer, very comprehensive and that is still basically there on the table and what we're offering now is more precision about certain elements of that," he added.

The 2008 offer both acknowledged Iran's right to a civilian nuclear program and recognized its need for broader security guarantees against attack.

SANCTIONS SEEN BITING

Western diplomats argue that sanctions are taking their toll on Iran's economy and hoping as a result the new diplomatic push could succeed where past attempts have failed.

The negotiations held by the P5+1 also follow a renewed offer by the United States to hold direct talks with Iran if it showed it was serious about reining in its nuclear program.

Any broader political dialogue between the United States and Iran would be aimed at reducing mistrust dating back to the 1979 Iranian revolution and seizure of the U.S. embassy in Tehran. Such a dialogue would be a means of giving additional momentum to existing negotiations on Tehran's nuclear program.

Iran has given little indication of what it would bring to the table in Almaty.

It rejected the offer of an easing of sanctions on gold trade as unacceptable and its ability to make significant concessions is seen as limited before Iranian presidential elections in June.

It has, however, resumed work to convert small amounts of higher-grade enriched uranium into fuel, a move which would slow its accumulation of stockpiles that could, if enriched further, be used for weapons.

Diplomats say it has also held off from putting into operational additional centrifuges at Fordow where it enriches uranium to 20 percent - a level that can be rapidly turned into weapons-grade material.

The International Atomic Energy Agency is expected to issue shortly its latest report on Iran, which will indicate the size of its stockpiles of enriched uranium and detail other developments in its nuclear program.

(AP) ? At a time when many robberies take place at the click of a mouse, a group of jewel thieves has shown there's still a potential payoff for old-fashioned criminals willing to use disguises, planning and pluck to nab their loot.

Monday's theft of some $50 million worth of diamonds from the tarmac of Brussels' international airport is a "huge blip on the radar," said retired FBI agent Bill Rehder, who spent more than three decades on Los Angeles' bank robbery squad.

"You can almost liken it to the meteor that hit in Russia," he said, referring to the space rock which exploded last week over the city of Chelyabinsk, injuring hundreds. "These things happen so infrequently, but when they do happen it's a huge story."

It's also the type of story that complicates trends that have seen many crimes ? particularly those targeting banks ? jump from the world of brandished weapons and ransom notes to a universe of Trojan software and password-stealing computer programs.

In several Western countries, robberies have fallen as banks have installed bullet-proof glass, access-control vestibules and cash boxes rigged with paint or glue. Rehder said that, in the United States, tougher sentencing for criminals and societal changes have also led to a drop in bank robberies, which shrank from 8,516 in 2001 to 5,086 in 2011.

That trend has been echoed across the Atlantic, with the British Bankers' Association recording an even more dramatic fall in the number of raids, from 232 to 66 in the same period. Europe-wide figures also show a decrease in the number of bank robberies.

Meanwhile, cybercriminals have stepped in to steal some of the money their gun-wielding colleagues have left behind.

Global figures are hard to come by, but the amounts in play can be huge. In 2010, the FBI announced the unraveling of an online organization that had raked in roughly $70 million through a vast network of hackers, money mules, and front companies. Dozens were arrested across the U.S., Britain, and Eastern Europe.

ATM skimming, in which criminals surreptitiously rig cash machines with card readers and cameras to harvest debit card numbers, is another threat.

Doug Johnson, the vice president of risk management at the American Bankers Association, said that while the average U.S. bank robber could expect to make out with $3,000-4,000 from each theft, a skimmer made 10 times that amount with every successful hit.

Even as criminality mutates to fit the new realities of online finance and cashless wallets, spectacular thefts like the one in Belgium carry a special air of romance, Rehder said.

"This will catch the imagination of the public, no doubt about it," Rehder said, explaining that the use of bogus police vehicles to rob a plane right as it prepared to take off fit right in with the mystique of 1960s heist movies, released long before many of today's online criminals were born.

And security experts said that capers in the vein of "The Thomas Crown Affair" (1968) or "Ocean's Eleven" (1960) ? elaborate schemes involving the surgical extraction of jewels, rare artwork, and cash ? were likely to keep popping up well into the information age.

"As long as we have hard currency and value in precious stones and precious metals, we're going to have people who will try to take it," Rehder said.

Or, as Johnson put it, "it's frankly difficult to create virtual robbery of diamonds."

Nudes check out nudes at Austrian museum

VIENNA (AP) ? These museum goers didn't just leave their coats at the coat check. They handed over their shirts, trousers and underwear.

Everything, in fact, except their shoes and socks. After all, the stone floor can get chilly when you're touring an art exhibit in the nude, which was what more than 60 art lovers did in a special after-hours showing at Vienna's prestigious Leopold museum.

For many, the tour of "Nude Men from 1800 to Today" ? an exhibit of 300 paintings, photographs, drawings and sculptures focused on the bare male ? was a goose-bump-raising instance of life imitating art.

"I can't say I'm sweating," said office worker Herbert Korvas as he stood waiting in the atrium with other young men, wearing only socks, sneakers and a smile. Despite the cold, he said he was drawn to the idea of naked museum viewing "because it was something different."

But after a while it really wasn't. With no other viewers around, nude quickly became the new normal as the visitors quickly gathered around a ? dressed ? exhibition guide and moved slowly from one art work to the next, listening intently to their history.

And they weren't the first visitors to get naked either, despite the hoopla around the event that drew dozens of reporters and camera teams from Austria and elsewhere.

A man had already stripped at the exhibition of pictures and sculptures in November, calmly sauntering through the exhibition and dressing again only after a security guard asked him to do so. That act made news ? and sparked demand for Monday's all-nude showing, said museum spokesman Klaus Pokorny.

"We got requests from all over the world from people who were inspired by the exhibition ... who asked us, 'Can we visit the exhibition naked?'" he said.

On Monday, interest was definitely skewed along gender lines. Irina Wolf smiled as she looked around at the mostly male crowd lining up for tickets.

"I'm at a big advantage here," she said. "Only men around."

While Wolf said she is not someone who regularly strips in public places, the 40-something computer engineer and occasional theater critic, said "I want to see how I relate to such a group."

For others, Monday's event fulfilled a long-cherished wish ? even though they had a hard time explaining why.

Florian Kahlenberg from Munich said he found it "interesting to stroll through a museum naked," adding. "I've always wanted to do that."

Few visitors, naked or dressed, have complained about the show, despite some explicit material showing sexual acts. Described as among the most successful ever staged by the Leopold, it has drawn well over 100,000 people.

That fits with Vienna's relaxed attitude. Its turn-of-the-century decadence allowed Egon Schiele and Gustav Klimt to flourish, and the Leopold itself has a world-class collection of those and other artists known for their explicit depiction of the flesh.

But the Austrian capital's acceptance of nudity goes beyond museum exhibits. Thousands of men, women and children skinny dip daily in the Danube along stretches reserved for them during the summer, while racy lingerie ads dot huge billboards across the city all year round and a mass-circulation daily regularly prints photos of half-naked women.

Still, there are limits to Viennese tolerance. The Leopold was forced into cover-up mode last year after complaints over promotional posters plastered city-wide that showed three young and athletic men of different races wearing nothing but blue, white and red socks and soccer boots.

Swaths of red tape were subsequently placed over their sensitive parts.

Iraq's al Qaeda wing claims Baghdad blasts

BAGHDAD (Reuters) - Al Qaeda's Iraqi wing claimed responsibility on Monday for car bomb blasts that killed 28 people in Shi'ite Muslim districts in Baghdad, saying it was taking revenge for perceived state repression of Sunni Muslims.

The al Qaeda affiliate Islamic State of Iraq and other Sunni Islamist groups oppose Prime Minister Nuri al-Maliki's Shi'ite-led government which they say discriminates against the country's Sunni minority.

Once at the heart of the insurgency against U.S. troops in Iraq, al Qaeda now targets mainly Shi'ites and local security forces in an attempt to trigger the kind of widespread sectarian violence that drove the oil producer to the edge of civil war in 2006-2007.

"We say to the Sunnis in Baghdad and elsewhere: The situation in which you are living today is exactly what the mujahideen warned you of years ago. You are walking in a dark tunnel," said the statement posted on an Islamist website on Monday.

At least eight car bombs exploded near shops, restaurants in Baghdad's busy commercial streets on Sunday.

One blast tore off shop fronts in Qaiyara district while another left the remains of a car and its twisted engine littered across a high street in the busy, commercial Karrada district.

Insurgents are stepping up attacks at a time when Maliki is facing two months of protests by thousands of Sunni Muslims in western provinces, who accuse his government of marginalising their sect.

Maliki's power-sharing government includes Shi'ites, Sunnis and ethnic Kurds. The Shi'ite premier has offered concessions to protesters, such as releasing detainees held by security forces and modifying laws Sunnis say are used to target them.

The wave of attacks was the latest sign of a campaign that has escalated since the start of the year and had heightened the risk of wider inter-communal violence in the OPEC country.

Islamic State of Iraq and other Sunni Islamist groups have carried out at least one major assault a month since the last U.S. troops left in December 2011. But since January, more than ten suicide bombers have struck different targets.

Premier Diagnostic Announces Debt Settlement Agreements

VANCOUVER, BRITISH COLUMBIA--(Marketwire - Feb. 18, 2013) -

Premier Diagnostic Health Services Inc. ("PDH") (CNSX:PDH) is pleased to announce that Premier has entered into debt settlement agreements with a number of current and former members of senior management (the "Management Settlement Agreements") and with a former supplier (the "Supplier Settlement Agreement") to convert their demand loans and other debts payable by the Company into Common Shares of the Company.

Nestle finds horsemeat in beef pasta meals

LONDON (Reuters) - Nestle , the world's biggest food company, has removed beef pasta meals from sale in Italy and Spain after finding traces of horse DNA.

The discovery of horsemeat in products labeled as beef has spread across Europe since last month, prompting product withdrawals, consumer anger and government investigations into the continent's complex food-processing chains.

Swiss-based Nestle, which just last week said its products had not been affected by the scandal, said its tests had found more than 1 percent horse DNA in two products.

"We have informed the authorities accordingly," Nestle said in a statement on Monday. "There is no food safety issue."

Nestle withdrew two chilled pasta products, Buitoni Beef Ravioli and Beef Tortellini, in Italy and Spain,

Lasagnes ? la Bolognaise Gourmandes, a frozen product for catering businesses produced in France, will also be withdrawn.

Nestle was suspending deliveries of all products made using beef from a German subcontractor to one of its suppliers, Nestle said.

Governments across Europe have stressed that horsemeat poses little or no health risk, although some carcasses have been found tainted with a painkiller banned for human consumption.

But the scandal has damaged the confidence of consumers in supermarkets and fast fold chains since horsemeat was first identified in Irish beefburgers.

Retailer Lidl said on Monday it had withdrawn products from its stores in Finland and Sweden after finding traces of horsemeat.

Yahoo Is Not Pleased With Its Microsoft Search Deal

CEO Marissa Mayer made comments at the Goldman Sachs Technology and Internet Conference in San Francisco on Tuesday expressing disappointment with the deal. Reuters quotes her:

?One of the points of the alliance is that we collectively want to grow share rather than just trading share with each other??

?We need to see monetization working better because we know that it can and we?ve seen other competitors in the space illustrate how well it can work.?

Rumors have existed for quite some time, that Yahoo and Microsoft could kill their search deal early, but we?ve heard nothing substantial enough to suggest this is going to happen. However, Yahoo seems to be getting increasingly impatient.

Yahoo is a different company than it was when it made the deal with Microsoft. Marissa Mayer is the fifth person to hold the CEO position while the deal has been in place (granted, two of them were interim CEOs). It was announced under Carol Bartz, and has gone through leadership from Tim Morse, Scott Thompson, Ross Levinsohn, and finally Mayer.

Mayer is, of course, a former Googler, and has brought other former Googlers along for the ride. Since Mayer has been at Yahoo, the company seems to be closer with Google than any other time in recent memory. In fact, last week, Yahoo announced a new partnership with Google (non-exclusive) for contextual ads, which will see Yahoo displaying contextual display ads from Google on various Yahoo properties and ?certain co-branded sites? using Google?s AdSense for Content and AdMob advertising offerings.

?By adding Google to our list of world-class contextual ads partners, we?ll be able to expand our network, which means we can serve users with ads that are even more meaningful,? said Yahoo in its announcement. ?For our users, there won?t be a noticeable difference in how or where ads appear. More options simply mean greater flexibility. We look forward to working with all of our contextual ads partners to ensure we?re delivering the right ad to the right user at the right time.?

We asked Microsoft?s Stefan Weitz about Google and Yahoo?s partnership last week, when we spoke with him about Microsoft?s new ?Scroogled? campaign. The only comment he offered on the subject, was ?I?d say I wonder how Google is using the content [of] your private communications in Gmail to serve ads in other places.?

Google Executive Chairman Eric Schmidt recently expressed interest in partnering with Yahoo, years after the two companies tried to partner on a similar search deal to what Yahoo has with Microsoft. The partnership never happened thanks to the threat of regulation, so Yahoo settled for Bing, which regulators did not have a problem with.

Since all of that, Google has cleared some significant regulatory hurdles (though it faces others). Last month, the company settled with the Federal Trade Commission, which found that Google?s search practices did not violate antitrust law.

A couple weeks ago, Yahoo released its earnings report for Q4 and the full year 2012. The report was better than many analysts had expected, and this was helped significantly by better-than-expected search performance. Mayer made some comments during the company?s earnings call, indicating that search is a major priority at Yahoo. Wired quoted her:

?Overall in search, it?s a key area of investment for us,? Mayer said. ?We need to invest in a lot of interface improvements. All of the innovations in search are going to happen at the user interface level moving forward and we need to invest in those features both on the desktop and on mobile and I think both ultimately will be key plays for us.?

?We have a big investment we want to make and a big push on search. We have lost some share in recent years and we?d like to regain some of that share and we have some ideas as to how.?

It was interesting to see this emphasis put on search, but still on the front end, which would seem to imply that Yahoo is happy to continue outsourcing the back end. It makes you wonder what Mayer?s thinking, particularly if she?s not happy with the Microsoft/Yahoo deal performance.

Last week, reports emerged that Russian search engine Yandex has surpassed Bing in global search queries, though as Danny Sullivan at Search Engine Land notes, Bing is still well head of Yandex in unique searchers.

Recent research from RKG has indicated that the Yahoo Bing Network continues to take away market share from Google, as Bing recently pointed out to us, noting that Bing Ads have gained paid search spend share from Google four quarters in a row.

Obviously it?s not benefiting Yahoo to the extent the company would like.

Microsoft did tell us about some new ad formats that it will be launching this year, such as Google-like product listing ads and click-to-call ads with Skype integration. Both formats have proven popular with Google advertisers, and the Yahoo Bing Network continues to strive to emulate Google?s success.

David Pann, GM of Microsoft?s Search Network tells us that advertisers come over to the Yahoo Bing Network with the mentality of ?It performs well over there [Google], so it will here too.?

Will Yahoo and Microsoft?s Search Alliance stay in place? How long will Yahoo remain patient?

This is not the first time we?ve seen Yahoo speak publicly about dissatisfaction with Microsoft in recent memory. Regarding IE 10?s ?Do Not Track? default, Yahoo recently slammed Microsoft saying that the company?s move ?degrades the experience for the majority of users and makes it hard to deliver our value proposition to them.?

That was not an off the cuff remark. That was an official blog post.

At the conference, Mayer also reportedly made comments expressing an interest in strengthening Yahoo?s relationship with Facebook (a big partner of Bing?s). Bloomberg reports that Mayer said she plans to focus on mobile apps and strengthening ties with Facebook to ?bolster turnaround efforts at the biggest U.S. web portal.? Brian Womack and Peter Burrows quote her:

?A lot of the strengths of Facebook are available to Yahoo users,? Mayer said yesterday at an investor conference in San Francisco hosted by Goldman Sachs Group Inc. ?That?s something we want to build upon. We have a real commitment to bringing valuable content to our users.?

Enhancing social features is crucial to Yahoo?s success, Mayer said, as she reinforced her preference to partner with companies like Google, Apple Inc. and Facebook rather than build expensive new products.

Facebook CEO Mark Zuckerberg said he would ?love? to work with Google at a recent company press event, though he indicated that those two companies aren?t really on speaking terms. He did, however, also say, ??We want to work with any company as long as they?ll honor the privacy of the folks on Facebook.? (as quoted by The Verge).

The rare gathering of marine mammals was given the name ?super-mega-pod.??Typically dolphins swim in pods of 15 to 200.

?I?ve seen a lot of stuff out here? but this is the biggest I?ve ever seen, ever,? Dutra told the local NBC affiliate.

The trail of dolphins was nearly seven miles long and five miles wide, Dutra estimated.

Experts have not been able to explain why so many dolphins were seen traveling together.

?They?re definitely social animals, they stick together in small groups. But sometimes, the schools come together,? marine expert Sarah Wilkin told NBC.

Though this is an extremely rare occurrence, huge numbers of dolphins were seen flocking together this time last year.

A YouTube video called ?Dana Point Dolphin Stampede Dana Wharf? went viral, with some saying the dolphins were sensing the apocalypse in California.?

Florida hit by 'tsunami' of tax identity fraud

MIAMI (Reuters) - Bruce Parton was only a few weeks from retirement after 30 years as a mail carrier in sunny Florida.

He never lived to fulfill his retirement plan of moving back to a quiet life in the Catskill mountains of New York, not far from where he grew up on Long Island.

Instead, he was gunned down on his daily mail route in December 2010 by members of an identity theft ring who stole his master key as part of a scheme to claim fraudulent tax refunds.

Using stolen names and Social Security numbers, criminals are filing phony electronic tax forms to claim refunds, exploiting a slow-moving federal bureaucracy to collect the money before victims, or the Internal Revenue Service, discover the fraud.

Parton was a victim of what officials say has ballooned into a massive, and dangerous, illegal industry that could cost the nation $21 billion over the next five years, according to the U.S. Treasury Department.

While that is a relatively small sum compared to the $1.1 trillion collected from individual tax payers in the last fiscal year, the crime has been growing by leaps and bounds in the last three years.

"We are on the top of a national trend that is causing a hemorrhage of tax dollars," said Wifredo Ferrer, United States Attorney for south Florida. "It's a tsunami of fraud."

While the IRS says it has detected cases in every state except North Dakota and West Virginia, the fraud's epicenter is Florida, and it is mostly concentrated in Miami and Tampa.

Miami has 46 times the per-capita rate of false tax refund claims than the rest of the country, and 70 times the national average in dollar terms, Ferrer told Reuters.

"For whatever reason, we always tend to lead the nation when it comes to fraud," he said, noting that his office has been battling massive Medicare fraud in recent years that has since spread to other parts of the country.

Florida's high proportion of older residents, who can be more vulnerable to fraud, may be one reason for the high levels of fraud in the state.

Nationwide, the number of cases of tax identity theft detected by authorities sky-rocketed to more than 1.2 million cases in 2012 from only 48,000 in 2008, according to the Treasury Department.

The real number of phony tax filings is likely much higher as the fraud is hard to track, according to a November General Accountability Office report.

GANG LINKS

The tax ID theft problem is particularly troubling as, unlike Medicare fraud, it is associated with violent crime and armed gangs.

Tampa police first detected it in 2010 when officers discovered wanted street criminals engaged in tax fraud. "They were holed up in hotels with laptops churning out tax claims," said congresswoman Kathy Castor, who represents the area and is pressing the IRS to get tougher on the fraud.

When agents raided a Howard Johnson in East Tampa in late 2010, they found suspects smoking marijuana and four laptop computers being used to file fraudulent tax returns on Turbo Tax, the tax preparation software, according to police records.

The suspects had lists of personal information containing more than 1,000 names and confidential personal information, multiple re-loadable debit cards, and records of numerous financial transactions. The investigation revealed that the suspects had been camped out in the hotel room for more than a week filing claims.

Tax identity fraudsters are apparently drawn by the ease of the crime, officials say.

"The scheme is very basic, it works virtually the same in almost every case," said Ferrer. "All they need is your name and the tax ID number."

Armed with that information a refund claim can be filed electronically, making up other details on the form, including addresses, employer data, income and deductions.

Criminals obtain the vital numbers using various tactics, often by bribing office workers with access to personnel files inside companies, as well as large public institutions such as hospitals and schools, according to prosecutors.

Last summer a hacker stole 3.8 million unencrypted tax records from the South Carolina Department of Revenue in what is believed to be the largest security breach of a U.S. tax agency. Authorities say they do not know the hacker's motive.

One North Miami man, Rodney Saint Fleur, was charged last year with using the LexisNexis research service account at the law firm where he worked to access names and Social Security numbers of 26,000 people as part of an identity theft scheme, according to court documents.

Victims in Florida have varied from hospital patients, to Holocaust survivors at an elderly Jewish community center, as well as active duty military serving overseas.

In December, a former U.S. Marine from North Miami was sentenced to nearly five years in prison for stealing the identities of more than 40 fellow Marines stationed at Camp Leatherneck in Afghanistan as part of a plot to claim $54,000 in fraudulent income-tax refunds.

In Parton's case the criminals were after his master key that gives postal workers access to mail drop-off boxes and apartment mailboxes. He was shot twice in the chest by a gunman as part of a plot to steal identities in people's mail for tax refund fraud.

The gunman, Pikerson Mentor, 31, was sentenced last month to life plus 42 years.

More than 600 people turned up for Parton's funeral, including postal workers and people who got to know him on his route. "He had been doing that mail route for 10 years and he always had a smile for everyone," said his daughter, Nina Parton.

The criminals stay under the radar using identities of the elderly or the very young, who are unlikely to be filing for earned income, as well as the deceased. They typically claim small refunds, around $3,000, but use multiple identities, with payments often made to pre-paid debit cards.

FIGHTING BACK

The IRS said last week it is intensifying a crackdown on identify theft, with 3,000 agents devoted to tackling the problem, double the number assigned in 2011.

The number of IRS criminal investigations into identity theft more than tripled in the year to September 2012, and it was on pace to double again this year, acting IRS Commissioner Steven Miller told reporters.

The tax collection agency prevented $20 billion in attempted tax refund fraud in fiscal year 2012, up from $14 billion a year earlier, he said.

"It's one of the biggest challenges that faces the IRS today," Miller said. "We're doing much better on all fronts but we have much more to do."

Despite the increase in investigations, the agency still had a backlog of 300,000 cases of people waiting for legitimate refunds after they were victims of fraud. It takes an average of six months to resolve a case, Miller said.

"The IRS have put a lot of resources on it, but they always seem to be behind the curve," said Keith Fogg, a tax professor at Villanova University School of Law.

Electronic filing, which now accounts for 80 percent of returns and was introduced to speed up delivery of refunds, has made the system more vulnerable to fraud.

The IRS is seeking to speed up the loading of data from W-2 payroll forms issued at the beginning of the tax season, a time lapse which gives fraudsters a window of opportunity to file using false data.

The IRS is also looking for ways to authenticate the identity of tax filers at the time of filing to pre-empt fraud, as well as working with the Social Security Administration to limit access to a registry of social security data of deceased tax payers, the so-called "Death Master File", a frequent target of fraud.

"We will not be prosecuting our way out of this. That's not going to be the answer. We're going to have to make it more and more difficult for criminals to profit from this behavior," said Miller. "If they're not successful they will move onto something else."
